Terms of Service

FOCUSZ (‘we’, ‘us’, ‘our’) is a digital studio that designs and builds websites, landing pages, mobile apps, ecommerce experiences, and marketing campaigns for clients worldwide. You can reach us at hello@focusz.studio.

You may browse our website for personal and business purposes. You agree not to misuse the site, attempt to gain unauthorised access, interfere with its operation, or use it in a way that violates any applicable law.

When you engage FOCUSZ for a project, the specific scope, deliverables, timeline, and fees are documented in a written proposal or statement of work (‘SOW’). The SOW, together with these Terms, forms the agreement for that project. If anything in the SOW conflicts with these Terms, the SOW controls for that project.

Fees, payment schedule, and currency are described in each SOW. Unless the SOW says otherwise, invoices are due within 14 days of issue. Late payments may pause work until the balance is settled.

To keep projects on schedule, you agree to provide the content, access, approvals, and feedback we reasonably need within the timelines set in the SOW. Delays caused by missing input may shift the delivery date.

Once a project is paid in full, you own the final deliverables produced specifically for you. FOCUSZ retains ownership of any pre-existing frameworks, tools, code libraries, and know-how used to create them, and may reference the finished work in our portfolio unless the SOW says otherwise.

Projects may rely on third-party platforms such as hosting providers, analytics, payment processors, or content management systems. Their terms and pricing apply to your use of those services, and we are not responsible for their availability or performance.

We build every project with care, but the website and services are provided ‘as is’ without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not guarantee any specific business outcome such as search ranking, traffic, or revenue.

To the fullest extent permitted by law, FOCUSZ will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the website or our services. Our total liability for any claim relating to a project will not exceed the fees you paid us for that project.

Either party may end an engagement in accordance with the termination terms in the applicable SOW. Fees for work already performed remain payable, and sections of these Terms that by their nature should survive termination will continue to apply.

We may update these Terms from time to time. The ‘Last updated’ date at the top reflects the latest version. Continued use of the website after changes are posted means you accept the updated Terms.

These Terms are governed by the laws of the jurisdiction where FOCUSZ is established, without regard to conflict-of-law rules. Any dispute will be resolved in the competent courts of that jurisdiction, unless a written agreement between us specifies otherwise.
